Coast truckie's widow loses bid for compo
THE Sunshine Coast widow of a truck driver who was killed in a crash two years ago has had her appeal for compensation dismissed.
The Queensland Industrial Relations Commission determined that Warren Gattera was not an employee of Nationwide Heavy Haulage at the time of the accident, though he was driving their truck, wearing an NHH uniform and working on an hourly rate.
Mr Gattera was killed on April 14, 2011, when his road train sideswiped a cattle truck on the Capricorn Hwy, west of Emerald.
Mr Gattera's widow, Melissa Gattera, appealed against a WorkCover Queensland decision not to accept her application for compensation.
Mr Gattera was employed by NHH between March 16-29, 2011, but entered into an arrangement from March 30 where he provided labour hire services to the company as a director of Gattera Enterprises Pty Ltd.
The IRC rejected the submission that NHH held a contract with Gattera Enterprises for any services and the agreement was simply an invoicing arrangement.
