Teenager convicted of sex with 15-year-old

A TEENAGER who committed three carnal knowledge acts with his then-girlfriend had previously been convicted for deprivation of liberty over an incident involving a foster carer and her seven-year-old son.

The now 18-year-old received a 12-month probation order and 100 hours of community service in 12 months for the carnal knowledge charges.

The sentence, handed down on Wednesday, followed a trial where the teen was found not guilty of rape and common assault in relation to the same 15-year-old victim of the carnal knowledge charges.

During the trial, the court heard the teen boy and the 15-year-old girl had been in a relationship for two months and had unprotected sex three times.

During sentencing proceedings, crown prosecutor Tiffany Lawrence said the boy had been convicted two years ago for the offence of deprivation of liberty.

She said he had grabbed his foster carer and pushed her up against a wall, placing his hand over her mouth after she asked him to leave her bedroom.

Ms Lawrence said the woman broke free but was grabbed by the teen and pushed back onto the bed, where he straddled her and placed his hand over her mouth again.

She said he then placed a chair against the door and sat on it so the woman and a child could not leave.

Defence barrister Ross Lo Monaco said the teen had become attached to the carer and was upset as he had been told he would have to leave the care house.

He said the teen had lead a "very disrupted life so far", living with at least nine foster care families.

Judge Michael Burnett said this teen, more than anyone, needed guidance.

"The sad fact is that leaving school in Grade 9 gives you no opportunities in life at all," he said.

"You need to get yourself an education."
