P-plater thought he was under limit the next morning

A P-PLATER caught driving over the limit was disqualified from driving for five months and fined $700.

Jacob Anthony Sowten appeared in the Gladstone Magistrates Court on Monday on one charge of drink driving.

The court heard Sowten was intercepted by police on Toolooa St at 4.40am on Sunday, April 21.

He returned a reading of 0.089% when breath tested.

His lawyer told the court her client had been drinking the previous evening and thought he was okay to drive.

A conviction was recorded against Sowten.
